The Information We Collect and How We Use It
To participate in the eMiles Service, you must register and provide enrollment contact information (for example, your full name, gender, zip code, e-mail address, and types of emails to be received and such other information that we may request). It is optional for you to provide demographic data (for example, income and education) and profile data (for example, occupation, travel frequency and areas of interest), but it is encouraged so we can provide a more personalized experience. Specifically, we use this data to customize and tailor your experience with the eMiles Service and website, showing you content in which you may be interested and displaying content according to your preferences. eMiles Service users will receive emails in our opt-in e-mail and web program. Users will earn eMiles points that can be deposited into the users’ selected Sponsor accounts.
Singular Summary and Aggregate Statistical Information
eMiles reserves the right to share information you provided in summary and/or aggregate form with our sponsors, our partners and other third parties. Summary information is data that describes the interest profile and demographics data of a Member without specifically identifying the Member. For example, this data does not contain personally identifying information such as a full name or e-mail address. Aggregate information is data that describes the interest profiles and demographics of Members as a group (in the aggregate) without specifically identifying any single Member who helps comprise that group. This data also does not contain personally identifying information such as a full name or e-mail address but describes group interest profiles (for example, car brand preferences of Members as a group) and group demographic information (for example, the average age of Members as a group).
Your Electronic Relationship with Our Marketers and Advertisers
Only with your consent will we share your enrollment contact information, including your full name, zip code and e-mail address, with marketers and advertisers who message you through the eMiles Service. If you so desire, this will enable you to foster a relationship with the marketers and advertisers and receive electronic communications from them. While we enter into agreements only with major brands with good business practices, eMiles will not be responsible for marketers’ and advertisers’ actions, including, without limitation, their use of information you supply to them.
We use other third parties such as our Sponsors (airline, hotel and other loyalty programs) or Reward Partners (retail gift cards being one example) to provide rewards for participating in our e-mail and web service program. When you sign up for the e-mail and web service program, we will share your program specific membership number and other information as necessary for the third party to provide that service. These third parties are prohibited from using your personally identifiable information obtained from eMiles for any other purpose including their own marketing. However, if you have elected to receive Sponsor promotions through a separate designation of preferences as a member of the Sponsor program, you will need to change your preferences directly with the Sponsor should your e-mail preferences change.
eMiles may, from time to time, invite you to participate in online surveys. The information requested in these surveys may include, but is not limited to, your opinions, purchase history and purchase intent regarding consumer and/or business products and services. Again, you are not required to provide us with this information. The information collected by these surveys may be used by eMiles to customize and tailor your experience with the eMiles Service and website. We reserve the right to share this information in summary and aggregate form with third parties.
eMiles may supplement the information you provide with statistical information that we obtain from third parties. We use this information to target our communications with Members more appropriately.
We employ a software technology called Web Beacons (a.k.a. clear gifs, pixel tags, web bugs) that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, Web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We normally do not tie the information gathered by Web beacons to our customers’ personally identifiable information. Sometimes, when a member takes an action on our site or an advertising partner’s site, a web beacon will inform eMiles of such action so appropriate miles can be awarded. We use Web beacons in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these emails, please see “Choice/Opt Out”.
The eMiles site may contain links to other Internet sites that are not operated or controlled by eMiles. We cannot control and are not responsible for the privacy practices, content, or goods and services available on such websites.
Communications from the Site
Special Offers and Updates
From time to time, we may send you additional eMiles earning opportunities which are promotional in nature. You will only receive these earning opportunities because you have signed up for our service. Out of respect for your privacy, we present the option not to receive these types of communications. Service Related Announcements
From time to time, we may send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send an e-mail. Generally, you may not opt-out of these communications which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.
Based upon the personally identifiable information you provide us, we will send you a welcome e-mail to verify your username and password. We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by e-mail or telephone, in accordance with your wishes.
We provide you the opportunity to ‘opt-out’ of having your personally identifiable information used for certain purposes, when we ask for this information. For example, if you give us your postal address but do not wish to have marketing material sent by us to that address, you can indicate your preference on the collection form. If you no longer wish to receive our communications, you may opt-out of receiving them by following the instructions included in each e-mail communication or by emailing us, at support@e-Miles.com, or you may contact us at 5800 Tennyson Parkway, Suite 600, Plano, Texas 75024 to opt-out. You will be notified when your personally identifiable information is collected for use by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party.
Non-Electronic Communications with You
In addition, we may engage third parties from time to time to assist us in operating our business. Such third party assistance may include, for example, performing reward fulfillment mail-outs on our behalf. You agree we may provide such third parties information you disclose to us. Such third parties may have access only to the personally identifiable information needed to fulfill their obligations toeMiles, but may not use it for any other purposes including their own marketing purposes. We may share your name, frequent flyer, sponsor account or reward partner program number and other such information that may be necessary to deposit or redeem eMiles miles with the airline, sponsor or reward partner you choose to complete the redemption.
How to Edit or Correct Your Personally Identifiable Information
By going to www.emiles.com, and clicking on Profile on our site, you may change your personal profile to better reflect your interests and view or modify personally identifiable information you have provided to us. By clicking on Settings you may update or delete certain contact information and limit the type of alert messages you receive in e-mail or other electronic format you would like to receive. When you are finished entering your updated information, click the appropriate button on the page to save your changes. Your changes will be recorded immediately, but some in-process based promotions may still be based on your old information. If there is incorrect information on your eMiles account statement, please contact us via e-mail at support@e-Miles.com. We will respond to your request within 30 days of receipt. We will retain your personal information unless your account is deactivated or terminated. If you wish to terminate your account or request that we no longer use your personal information to provide you services, please contact Member Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.
We are Committed to Data Security
eMiles implements security measures (including online and off-line physical, electronic and managerial safeguards) designed to help protect against the loss, misuse and alteration of the information under our control. As with any transmission over the Internet, however, there is always some element of risk involved in sending personally identifiable information online. Your e-mail address, password and cookie will be required to update your personally identifiable information (name, e-mail address, etc.), and your Member profile data. Remember to keep your password private and secure — you should not share this information with anyone. Although we do not collect sensitive data (SSN, Credit Card info, etc.) while on our site, we do employ SSL encryption to further protect your information on various pages on our site.
We are Committed to Children’s Privacy
You are only able to participate in the eMiles Service if you are at least 18 years old. eMiles takes children’s privacy seriously and we do not seek to collect personally identifiable information about children under 18 years of age. If we find out we have collected information from anyone under the age of 13, we will delete this information immediately.
Our Opt-Out Policy
If you would like to opt out of eMiles membership, you may request that your membership be cancelled and account closed by contacting Support. The use of any other mechanism to request that your membership be cancelled could result in the delay of your membership cancellation. eMiles may continue to use information collected prior to cancellation. Such cancellation may not terminate any third-party program you have elected to participate in while a Member.

Except as provided herein, we promise that we will never willfully sell, trade, rent or make available your identity, e-mail address, phone number or home address to any unaffiliated third party without your consent, or unless we believe in good faith that such action is reasonably necessary (and in which case, no consent must be sought): to comply with the law or any legal process; to investigate, prevent or take action regarding illegal activities or suspected fraud; to establish, protect and/or defend our rights and property; or to protect against violations, misuse or unauthorized use of the eMiles Service or eMiles miles. Notwithstanding anything herein, eMiles may share and disclose personally identifiable information to its affiliates and as part of a sale of its business whether through a sale of assets, stock or other change of control transaction. If eMiles, Inc. is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
